Telecommunications (Competition Provisions) Appeal Board

The Telecommunications (Competition Provisions) Appeal Board is an independent statutory body constituted under section 32L-U of the Telecommunications Ordinance (Cap. 106) to determine appeals against the Communications Authority in enforcing fair competition in the telecommunications market in Hong Kong.

Terms of Reference

The Telecommunications (Competition Provisions) Appeal Board is the first ever sector-specific appeal board on competition matters in Hong Kong. It provides an independent avenue for aggrieved parties to review the decision of the Communications Authority on competition matters. Its terms of reference are as follows:

1. To deal with appeals under section 32N of the Telecommunications Ordinance (Cap. 106) by any person or carrier licensee who is aggrieved by any opinion, determination, direction or decision of, or any sanction or remedy imposed by the Communications Authority (as the case may be) relating to sections 7K-7N or 7P of the Ordinance.
   
   
2. To determine appeal by upholding, varying or quashing the appeal subject matter and make consequential orders (reference: section 32O(4) of Telecommunications Ordinance).
